Please read these Terms of Service carefully before using PurpleChipMonk. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, you may not use our services.

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and FortyFour AI, LLC and www.purplechipmunk.com (“PurpleChipMonk,” “we,” “us,” or “our”), governing your access to and use of the PurpleChipMonk website located at www.purplechipmonk.com and all related services, features, content, and applications (collectively, the “Platform” or “Service”).
By creating an account, clicking “I Agree,” accessing, or using any part of the Service, you confirm that you:
- Are at least 18 years of age, or the age of legal majority in your jurisdiction;
- Have read, understood, and agree to be bound by these Terms and our Privacy Policy;
- Have the legal capacity and authority to enter into this agreement.
If you are accessing the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
PurpleChipMonk is an AI-powered job search operating system designed to help job seekers discover opportunities, tailor application materials, prepare for interviews, and manage their job search pipeline. The Service includes the following core modules:
2.1 Smart Job Discovery
Our AI engine scans more than 40 job boards daily, scores each listing against your profile on multiple fit dimensions (including skills alignment, salary range, culture indicators, and growth potential), and delivers a curated shortlist ranked by relevance.
2.2 Role Qualification Engine
Every matched role is scored across 10+ dimensions to help you evaluate fit before investing time in an application. Scores are provided as guidance only and do not constitute a guarantee of hiring success.
2.3 Resume Lab
PurpleChipMonk generates auto-tailored resumes and cover letters for each job target based on your uploaded master resume and the relevant job description. You remain responsible for reviewing all generated materials before submission. ATS compatibility scores are algorithmic estimates and are not guaranteed.
2.4 Interview Intel
The platform provides AI mock interview experiences trained on publicly available interview data and self-reported interview patterns. Scoring and feedback are generated by AI and are advisory in nature. We do not guarantee that mock interviews will reflect actual interview experiences at any specific employer.
2.5 Pipeline & Analytics
A visual Kanban-style board tracks applications from submission to offer. Conversion analytics are calculated from your personal activity data and do not reflect broader labor market outcomes.
2.6 Command Center
A natural language AI interface enabling you to search jobs, draft applications, manage your pipeline, and access all platform features through conversational input.
3. User Accounts
3.1 Account Registration
To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You may register using your email address or through supported third-party sign-in services (such as LinkedIn).
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Choose a strong, unique password;
- Not share your credentials with any third party;
- Notify us immediately at support@purplechipmonk.com if you suspect unauthorized access to your account.
PurpleChipMonk is not liable for any loss or damage arising from your failure to maintain account security.
3.3 Account Eligibility
The Service is intended for individual personal use by job seekers. Accounts created for commercial scraping, bulk data harvesting, or on behalf of third parties without authorization are prohibited.
3.4 Account Termination by User
You may delete your account at any time through the platform settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
4. Plans, Pricing, and Payment
4.1 Free Plan
PurpleChipMonk offers a free tier that includes job discovery, basic pipeline tracking, and limited interview preparation features. The free plan is available indefinitely subject to these Terms.
4.2 Premium Plans
Premium subscription plans unlock unlimited AI-generated application materials, advanced coaching, deeper analytics, and other enhanced features. Current pricing is available at www.purplechipmonk.com/pricing and is subject to change with notice.
4.3 Billing and Renewal
Premium plans are billed on a recurring basis (monthly or annually, as selected). Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You authorize us to charge your payment method on file for each renewal period.
4.4 Refund Policy
All subscription fees are non-refundable except where required by applicable law or at our sole discretion. If you believe a charge was made in error, please contact
billing@purplechipmonk.com within 30 days of the charge.
4.5 Free Trials
We may offer free trials of premium features from time to time. At the conclusion of a free trial, your account will revert to the free tier unless you elect to subscribe. We reserve the right to limit free trial availability and duration.
4.6 Taxes
You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities in connection with your use of the Service.
5. User Content
5.1 Your Content
You retain full ownership of all content you upload, submit, or provide to the Service (“User Content”), including resumes, work history, professional profiles, and any other personal or professional information.
5.2 License to PurpleChipMonk
By submitting User Content, you grant PurpleChipMonk a limited, non-exclusive, royalty-free, worldwide license to use, store, display, reproduce, and process your User Content solely as necessary to provide and improve the Service. This license terminates when you delete your account or the relevant content, subject to reasonable backup retention periods.
5.3 Accuracy of User Content
You represent that all User Content you provide is accurate, truthful, and does not infringe the rights of any third party. Submitting false or misleading information on resumes or application materials may violate laws and employer policies. PurpleChipMonk is not responsible for any consequences arising from inaccurate or fraudulent User Content.
5.4 AI-Generated Content
Content generated by PurpleChipMonk's AI tools (including tailored resumes, cover letters, and interview prep materials) is provided as a starting point for your review and editing. You are solely responsible for the accuracy, completeness, and appropriateness of any AI-generated content before submitting it to any employer or third party.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service to submit fraudulent, plagiarized, or misleading application materials;
- Attempt to gain unauthorized access to any portion of the Service or other users' accounts;
- Use automated bots, scrapers, crawlers, or similar tools to access or extract data from the Platform without express written permission;
- Reverse engineer, decompile, or disassemble any portion of the Service;
- Resell, sublicense, or otherwise commercially exploit the Service or any AI-generated output;
- Upload viruses, malware, or other malicious code;
- Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure;
- Harass, threaten, or harm any person in connection with using the Service;
- Violate any applicable local, state, national, or international law or regulation;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.
7. AI Features and Automation
7.1 Human Review Required
PurpleChipMonk's AI tools are designed to assist and accelerate your job search — not to replace your judgment. You acknowledge that:
- All AI-generated resumes, cover letters, and application materials require your review and approval before submission;
- PurpleChipMonk does not submit job applications to employers on your behalf without your explicit action;
- Match scores, qualification ratings, and interview prep content are algorithmic outputs and may not reflect actual employer requirements or outcomes.
7.2 No Employment Guarantee
Use of PurpleChipMonk does not guarantee employment, interviews, responses from employers, or any specific job search outcome. Interview rates and statistics displayed on the platform reflect aggregate or representative user data and are not a guarantee of individual results.
7.3 Third-Party Job Boards
Job listings surfaced by the Smart Job Discovery module are sourced from third-party platforms including LinkedIn, Indeed, Glassdoor, and others. PurpleChipMonk does not control the accuracy, availability, or continued posting of third-party listings. We are not responsible for the content, requirements, compensation representations, or hiring practices of any employer or job board.
7.4 AI Limitations
AI-generated content may contain errors, outdated information, or outputs that do not fully reflect your experience or the employer's requirements. Always review AI output carefully. PurpleChipMonk disclaims responsibility for decisions made in reliance on AI-generated content.
8. Privacy and Data Security
8.1 Privacy Policy
Your use of the Service is governed by our
Privacy Policy, available at www.purplechipmonk.com/privacy, which is incorporated into these Terms by reference. Please review it carefully.
8.2 Data Security
We implement industry-standard security measures to protect your data, including encryption at rest and in transit. However, no method of transmission over the Internet is 100% secure. You acknowledge that you provide information at your own risk.
8.3 No Data Sale
PurpleChipMonk does not sell your personal data to third parties. We may share anonymized, aggregated data for research or product improvement purposes.
8.4 Data Export and Deletion
You may export your data or request deletion of your account and associated data at any time through platform settings or by contacting
privacy@purplechipmonk.com. Certain data may be retained as required by law or for legitimate business purposes as described in our Privacy Policy.
9. Third-Party Integrations and Links
The Service may integrate with or link to third-party services and platforms, including LinkedIn, Indeed, Glassdoor, and payment processors. These integrations are provided for your convenience. PurpleChipMonk does not control and is not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is governed by their respective terms and policies.
When you connect a third-party account (such as LinkedIn) to PurpleChipMonk, you authorize us to access and use data from that account as described in our Privacy Policy and consistent with the permissions you grant.
10. Intellectual Property
10.1 Platform Ownership
The Service, including all software, AI models, algorithms, interfaces, designs, trademarks, and content (excluding User Content), is owned by or licensed to PurpleChipMonk and is protected by copyright, trademark, patent, and other intellectual property laws.
10.2 Limited License to Users
Subject to these Terms, PurpleChipMonk grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial job search activities.
10.3 Feedback
If you submit feedback, suggestions, or ideas about the Service, you grant PurpleChipMonk an unrestricted, royalty-free, perpetual license to use and implement that feedback without any obligation to you.
11. Disclaimers and Limitation of Liability
11.1 Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. PurpleChipMonk does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11.2 Limitation of Liability
To the maximum extent permitted by applicable law, PurpleChipMonk and its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or reputational harm, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.
Our total cumulative liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of (A) the amount you paid to PurpleChipMonk in the 12 months preceding the claim, or (B) one hundred US dollars ($100).
11.3 Essential Basis
The limitations and disclaimers in this section form an essential basis of the bargain between you and PurpleChipMonk. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless PurpleChipMonk, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of or access to the Service;
- Your violation of these Terms;
- Your User Content;
- Any misrepresentation in your job application materials;
- Your violation of any applicable law or third-party rights.
13. Termination
13.1 Termination by You
You may stop using the Service and delete your account at any time. Cancellation of a paid subscription does not entitle you to a refund for any prepaid period.
13.2 Termination by PurpleChipMonk
We reserve the right to suspend or terminate your account or access to the Service at any time, with or without notice, for any reason including, but not limited to, violation of these Terms, fraudulent activity, or extended account inactivity.
13.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Indemnification, Governing Law, and Dispute Resolution) shall survive.
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
14.2 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact us at
legal@purplechipmonk.com and attempt to resolve the dispute informally for a period of at least 30 days.
14.3 Binding Arbitration
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
14.4 Class Action Waiver
You and PurpleChipMonk agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
14.5 Exceptions
Notwithstanding the above, either party may bring claims in small claims court or seek emergency injunctive relief in any court of competent jurisdiction to prevent irreparable harm.
15. Changes to These Terms
PurpleChipMonk reserves the right to update or modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website with a new effective date;
- Sending an email notification to the address associated with your account;
- Displaying a prominent notice within the Service.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental agreements you enter into with PurpleChipMonk, constitute the entire agreement between you and PurpleChipMonk regarding the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. PurpleChipMonk may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
16.5 Force Majeure
PurpleChipMonk shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemic, government actions, internet service disruptions, or third-party platform outages.
16.6 No Third-Party Beneficiaries
These Terms do not confer any rights or remedies upon any third party.
